Los Angeles/Pretoria, South Africa- Nationwide Arrest Warrants for Linda Volschenk Berger, (see her Wanted Poster) were issued today for the re-abduction kidnapping (felony) of four year old Liam Berger (see Missing Persons Poster attachment and below). Less than a year ago in December 2006, the South African Supreme Court ordered her to return Liam to his legal U.S. custodial parent, 46 year old Marina Del Rey, California businessman Hal Berger. Liam Berger was ordered returned to the United States after it was ruled and ordered that he was unlawfully retained in South Africa for two years under the International Hague Convention by his mother Linda Volschenk Berger. ” How sad is this for Liam after finally back in the United States for ten months; celebrating his birthday in August, having made new friends and attending pre-school. His mother, Linda [Volschenk] Berger, re-abducted Liam on October 10th when she did not bring him to school.” states Hal Berger, the boys natural father who spent eight months in South Africa fighting in the strange courts of the Hague International law system. The media in South Africa know this story well including Berger living in fear of his life, hiring bodyguards to protect him, and living in hiding after his own father-in law and his friends seriously threatened to kill him. 

Hundreds of thousands of legal custodial parents are victims of a rogue spouse who for various reasons of their own take the child out of the home, state, or country illegally causing traumatic psychological damage to the child and the victimized parent.
“Imagine what its like coming home every day to your home filled with memories, clothes, photos, and toys of your child left behind . Because of the harmful effects on children, parental kidnapping has been characterized as a form of child abuse. Now that Liam is older, every second, minute, and day that he is not found he will suffer from separation anxiety and the harmful effects of being on the run”, said Berger. 

Even though new laws have recently been enacted to aid in stemming the incidents of international parental abduction( including the Sinclair-Cannon Act http://www.geocities.com/lsynclair/Synclair-Cannon_Law.html and the recently Senate passed Feinstein-Hutchison Family Abduction Prevention Act of 2007 which would authorize only $500,000 for its first year of enactment.  The funds would be used to provide matching grants to states for the costs associated with improving family abduction prevention programs.  Specifically, the bill assists states with training local and state law enforcement in immediately responding to family abduction especially those with a high probability of leaving the country. Berger has issues with the courts and law enforcement here especially this tough week since his child was abducted and most likely out of the country. ” The system does not have checks and balances for parental abduction cases between the courts that return an abducted child and the local family courts.”  In International Hague abduction cases Judges treat these cases like just any other divorce, not taking into consideration the trauma and risk associated with parental abduction. “Judge Hilberman in the Santa Monica Court, absolutely ignored the history of flight risk in this case and did not protect Liam. There is a 70%+ chance that an abducting parent will abduct again!” , says Berger.

Berger hopes that the new laws will be brought up to date and amended properly to protect kids from the horrors of international flight and the loss of their father or mother at the hands of a criminal spouse. ” It is real obvious that the local LAPD, law enforcement lack training and understanding of the importance of responding to parental kidnapping with the same urgency as non parental kidnapping.” If I had filed a report that I suspected a neighbor had taken my son, I would have had a warrant in two days not the two weeks this has taken for these warrants! A four hour delay in processing a warrant is the difference between catching an abducting parent and losing a child over the Mexican border here in Southern California.” continues Berger.

Hal Berger’s  pain is almost unbearable especially after the euphoria of being back with his son earlier this year. ( see photo of Liam and Hal Berger reunited) “People have no idea what it feels like to have your child torn out of your heart, every second, minute, day and month. A lot of parents miss their child when they go away for a weekend, imagine what it feels like to not see your child for months or years. Imagine what it’s like coming home every day to your home filled with memories, clothes, photos, and toys of your child left behind”. says Berger.
Hopefully Linda Volschenk Berger will be captured and Liam returned to his legal father before any further abuse is suffered.
